Davis Bacon Requirements

If assisted with federal funds, the project may be subject to the Davis-Bacon Act. Project Sponsor’s will be notified of the anticipated source of funds at the time of Reservation of Funds. Project Sponsors that receive federal funds from the PDC will then be notified of the criteria used to determine applicability of Davis Bacon requirements.

For projects required to comply with Davis Bacon requirements, any and all people who perform work on the project site must receive wages equal to or greater than the Davis-Bacon wage decisions as provided by the PDC. The Davis-Bacon Specialist approves disbursement of funds from the PDC after monitoring the weekly payrolls and other documentation. Diversity in Contracting

Project Sponsors must agree to comply with PDC requirements for the Minority Business Enterprise, Women Business Enterprise and Emerging Small Business (M/W/ESB) Program.

M/W/ESB conditions apply to construction projects with PDC financing of $100,000 or more and with construction costs greater than or equal to $200,000. The Commission sets a 20% goal for use of state-certified minority business enterprise, women business enterprise and emerging small businesses in PDC funded projects and applies it to the PDC funded portion of the construction project. If this 20% goal is not met, the Project Sponsor must document a good faith effort to contract with M/W/ESB’s, as outlined by the PDC. Although no goals are required for minority and women-owned firms, PDC requires its Project Sponsors to provide utilization information to assess its diversity-in-contracting programs.

Equal Employment Opportunity

The Project Sponsor must comply with all applicable provisions of federal or state statutes and regulations and City ordinances concerning equal employment opportunities for persons engaged in construction or rehabilitation work undertaken in connection with direct financial assistance.

Workforce Training and Hiring

Under the City’s Workforce Training and Hiring Program, the Project Sponsor must apply certain training and hiring requirements to prime construction contracts of $1,000,000 or more and to subcontracts of $100,000 or more. This program is applied to the entire project and not just the PDC financed portion. The goals of the Workforce Training and Hiring Program are to ensure that the PDC does business with contractors whose workforce reflects the diversity of the workforce found in the city of Portland and to ensure that the Commission's contracting dollars are leveraged to provide fair and equal opportunity to the City's diverse population. In support of these objectives, Project Sponsors are required to hire and train the maximum ratio of apprentices to journey workers allowed in each trade. The Project Sponsor must also show efforts to recruit women and minorities into apprenticeship positions.
